alright.
so i got fined the other weekend for havign possession of alcohol in a public place. the cops asked to search my bag. i didnt have the alcohol out or anything. they just asked to search my bag and so happen to find half a 40 of OE and a bottle of wine...
my questions. or topic of discusiion:
can they do that!?
ive herd mixed opinions. some say they can becuase they are the law, and if you had refused to let them search your bag, they would've suspected somethign was up.
others say they coodnt do that. they dotn have the right. we, the public, have the right to privacy.
so i dunno. tell me whats up.
anyway. i have to go pay a 58 dollar fine...
ps - they took my fuckin cap gun too. MY CAP GUN!...fuckers.

I don't think they can do that unless you let them.......which in this case you did. They blunder you into opening your bag for them, then they can look. I think , I'm not sure.
And its good that they took away your cap gun.......I got arrested for firing those things.

yea but they kind of made me open it. they asked if i had an beer int he bag. i said "no"(lie) and than they asked me to open it...
coodnt they have just taken my word(even if it was false haha)?

In the Canadian Charter of Rights and Freedoms it says "Everyone has the right to be secure against unreasonable search or seizure."
I've been led to believe that unless they saw you take something out of the bag, or put something in the bag that could arouse certain suspicion, they need something to warrant the search. I'm pretty sure they weren't allowed to do what they did.

Actually, they probably were, as long as they had Reasonable Probable Grounds. And since the event had a strict "no alcohol allowed" rule thinger, then they had the RPG to search all bags, to make sure the rule was being followed.

they werent inside the boundaries of the event. my mommie says, that if you challenge it, cops typically wont show up for a 58 dollar fine, the court will just throw it out. i mean hey, it saves you almost 60 bucks?

last night i got a ticket for 109 bones for not displayin' the ol' N. i had half a cooler like two hours before i got stopped so i probably has some blood alcohol. when the cop asked me if i had had taken any drugs or alcohol i got all awkward and nervous and said "n-no....................i d-dont do drugs". fuck i'm smooth

Yah, my daddy's a cop and I know that if you challenge it, the chance of a cop wasting his time is pretty slim. I don't think that they had the right though. As long as you weren't drunk--which if you were, keep in mind that you're underage and they could've fined you for that anyways--buuuuut, I dunno.
